KARA INSTRUMENTS TERMS & CONDITIONS

GENERAL. These Terms and Conditions constitute an integral part of any offer made by Roboz Surgical Instrument Company, Inc. (Seller) to sell goods to Buyer and shall govern the sale of the goods. Seller may reject any order from Buyer at any time for any reason. These Terms and Conditions are subject to change by Seller at any time.

Any additional or different terms or conditions proposed by Buyer in any purchase order or otherwise are hereby rejected. Buyer’s acceptance of all of the terms and conditions herein is an express condition of sale. Acceptance by the buyer of any goods shall be deemed acceptance of the terms and conditions stated herein.

TERMS OF PAYMENT. The payment terms for all orders are payment in an approved form in Advance of Shipment except where credit terms have been granted by Seller’s Accounting Department. Seller may require additional verifications or information before accepting any order.

RISK OF LOSS. Title to products and risk of loss or damage during shipment passes from Seller to Buyer upon delivery to a common carrier at Seller’s shipping point.

QUALITY GUARANTEE. All KARA Instruments are guaranteed to be free from defects in workmanship and material. Any KARA Instrument which proves defective in workmanship or material will be either repaired or replaced, at our discretion, without charge.

RETURN AND EXCHANGE POLICY. All requests for return or exchange must be made within 90 days of purchase and must be first authorized by Seller’s Customer Service representative. The seller will issue a Return Authorization Number that is to be placed on the outside of the return shipping container. All unauthorized returns will be refused. The seller determines, at our sole discretion, to issue a credit, perform an exchange, or not accept the return. A 10% restocking fee may apply. Seller reserves the right to inspect all returned goods before issuing credit. Issuing of credit is at Seller’s sole discretion. Credit may not be issued for instruments that have been used or damaged.

The following merchandise will not be accepted for return or exchange:

Used instruments
Color-coded instruments
Merchandise held longer than 90 days
Merchandise without a return authorization number

COPYRIGHT INFORMATION. All material published by Seller, including all catalogs, price lists, marketing material, and other printed material, and any web copy, images, logos, indicia, text, content, and unique method of displaying products in any of Seller’s websites is copyright and is the property of KARA Instruments Company. Any reproduction, partial reproduction, or misuse of the images or information in this website without the prior written consent of KARA Instruments is strictly prohibited.

TYPOGRAPHICAL ERRORS. Seller is not responsible for typographical errors in any of its printed material or any web site owned by Seller. In the event of a typographical error Seller shall have the right to refuse or cancel any order whether or not the order has been confirmed. If payment has been made and your order is canceled, Seller shall immediately issue a credit to your account in the amount of the charge.

LIMITATION OF LIABILITY. In no event shall Seller or any of its subsidiaries or affiliates be liable for any indirect, special, incidental or consequential damages including but not limited to loss of use, loss of data, loss of business or profits.

 

WARRANTY

KARA reusable instruments are produced to the highest standards using state-of-the-art technology and decades of expertise, guaranteeing repeatable quality and accuracy with every instrument.

We have been hand-making world-class Surgical Instruments for 30 years and believe in giving our customers uncompromising quality. Used by leading surgeons worldwide, our products deliver outstanding performance time after time.

Surgical Instruments manufactured by KARA are guaranteed to be free from defects in workmanship and materials for a minimum of 3 years.

In the unlikely event that any instrument is found to be unsatisfactory in normal use within 3 years of purchase, it will be refurbished or replaced free of charge. This guarantee does not cover products that have become defective through misuse, neglect, or repair by other companies. Please refer to our Manufacturer’s Instructions for cleaning and sterilizing to ensure our Surgical Instruments are reprocessed correctly.

KARA Instruments Warranty

KARA instruments guarantee that any instrument will be free of defects in materials and workmanship when used under normal conditions for its intended purpose. If an instrument is defective, KARA will at its sole option either repair or replace the instrument.

Many of the instruments manufactured by KARA are hand-finished by skilled craftsmen. Consequently, there may be slight variations in the dimensions of an instrument from those given in the listed specifications.

Disclaimer: The responsibility for the use of KARA products lies entirely on the user. Incorrect handling, sterilization, or use can significantly decrease the quality or effectiveness of KARA instruments.

Repair Service Warranty

KARA Surgical repair services are backed by our 100% satisfaction guarantee. If for any reason you are not satisfied with our repair services, please contact us. KARA instruments that are broken or non-repairable due to a manufacturer’s defect will be replaced at no charge to the customer.

Warranties are not valid for KARA instruments and products that prove defective as a result of improper care and cleaning or misuse.
